1. Overview
The Brush Collective ("the Platform") is an online marketplace that connects artists who wish to sell original paintings
with buyers who wish to purchase them. The Platform facilitates discovery, listing, and payment processing.
2. Platform Commission
The Platform charges a 20% commission on every painting sold through the marketplace.
This fee covers payment processing, platform maintenance, marketing, customer support, and infrastructure costs.
The remaining 80% is paid out directly to the artist via Stripe Connect.
3. Artist Responsibilities — Shipping
Artists are solely responsible for shipping sold paintings to buyers.
This includes packaging, selecting a carrier, paying shipping costs, providing tracking information,
and ensuring the painting arrives safely. The Platform does not handle, store, or ship any physical artwork.
Specifically, artists agree to:
- Ship the painting within 7 business days of receiving the order notification.
- Package the painting securely and appropriately to prevent damage in transit.
- Provide a valid tracking number through the Artist Dashboard.
- Bear all shipping and insurance costs, or include them in the listing price.
- Handle any shipping disputes, lost packages, or damage claims with the carrier directly.
4. Buyer Rights
Buyers are entitled to:
- Receive the painting as described in the listing.
- Receive shipping tracking information from the artist.
- Request a refund if the painting is not shipped within 14 business days, or if it arrives
significantly different from the listing description.
5. Artist Accounts & Payouts
To sell paintings, artists must create an account and connect a Stripe Express account for payouts.
Payouts are processed automatically by Stripe after a successful sale, minus the 20% platform commission.
Payout timing depends on the artist's Stripe account settings (typically 2-7 business days).
6. Prohibited Content
The following may not be listed on the Platform:
- Artwork that infringes on another artist's copyright or intellectual property.
- Reproductions, prints, or copies marketed as originals.
- Artwork containing illegal, obscene, or hateful content.
- Non-painting items (sculptures, digital art, NFTs, etc.).
7. Liability
The Platform acts solely as an intermediary. We do not guarantee the quality, authenticity, or condition
of any artwork listed. All transactions are between the buyer and artist. The Platform is not liable for
shipping delays, damage, or disputes between parties, though we will assist in mediation when possible.
8. Account Termination
The Platform reserves the right to suspend or terminate accounts that violate these terms,
fail to ship paintings within the required timeframe, or engage in fraudulent activity.
9. Changes to Terms
We may update these terms at any time. Continued use of the Platform after changes constitutes
acceptance of the updated terms. Significant changes will be communicated via email to registered users.
